About the user license/copyright and image rights
1.1) Can I freely use the images displayed on TYBA Online?
No. The images you see on our website are low-resolution, watermarked samples intended for online display
and search purposes only.
Why? Because all our displayed images are protected by international copyright law. Each image´s rights, in any physical or digital form, are reserved and can only be used after obtaining permission from TYBA Agência Fotográfica.

1.2) What do I need to do to use images from TYBA Online?
You must contact TYBA and request a quote for the usage rights based upon the following specifications, which you must provide:
- usage type (ex: promotional, editorial, institutional, other);
- media (ex: outdoor, magazine interior, cover image, other);
- final published size (ex: for editorial use - five images/half-page; one image/two-page spread);
- circulation (quantity of final print run);
- coverage (ex: regional [where?], national, international [where?]);
- and duration (ex: one month, one year).
All of this information can be provided to us online. To do this, you must register, pre-select your desired images using your personal lightbox, and request a quote.

1.3) What are author´s rights?
Photography is one of the types of works protected under Brazilian authorship law, law 5988, December 14, 1973, updated by law 9610, February 19, 1998 (integrated into the newer law) subordinate to item XXVII of Article Five of the Federal Constitution of 1988, in accord with the Berne Convention, established in 1886 in Switzerland, of which Brazil is a signatory.

1.4) When I use an image that highlights an individual do I need to get that person's authorization to use the image?
Yes, whoever desires to publish the image must obtain authorization from the person(s) highlighted in the image. A person's image is protected by Article Five of the Federal Constitution, citation X, which states: ". are inviolable the intimacy, the private life, the honor and the image of the people, securing the right of indemnity by material or moral damage resulting from its violation."
Publication can only occur after acquiring authorization, known as the "image rights", or a similar prearranged authorization. TYBA and its represented photographers have "image rights" contracts with some of the people appearing in our images, and these contracts are verified by citation of "image rights" beside the image. Permission of usage of these images will evaluated on a case-by-case basis after considering the purchaser's intended usage as provided on the order form.

1.5)What are image rights?
A – Commercial Use:
These are contracts with private citizens who have given authorization to use their image for a specified length of time. Remuneration is customary for the use of an image (notice that that links a person's image to a company's brandname) and in many cases for institutional and editorial use, varying in conjunction with the following items:
- usage type (ex: promotional, editorial, institutional, other);
- media (ex: outdoor, magazine interior, cover image, other);
- final published size (ex: for editorial use - five images/half-page; one image/two-page spread);
- circulation (quantity of final print run);
- coverage (ex: regional [where?], national, international [where?]);
- and duration (ex: one month, one year).
B – Editorial Use:
Care should be taken to use TYBA Online's images in a context which does not jeopardize the moral or ethical reputation of TYBA, its represented photographers, or the individuals displayed within the images.
TYBA and its represented photographers have contracts with some of the people appearing in our images, and these contracts are verified by citation of "image rights" beside the image.

1.6) When I "purchase"* an image, may I use the image as many times as I want?
No. A quote is based upon the intended usage information as previously provided during a quote request, and thus the usage of an image is restricted to those intentions, including any additional negotiated items after your initial quote request. This information is included in the written contract, the LR (Photographic Reproduction License), which you must sign. To reuse an image later, you must contact us to update the conditions of your contract.
*Although the word "purchase" is often used when negotiating the usage terms of an image, a more correct word would be "rental", because the ownership rights of the image remain with the author.

1.7) What is the LR (Photographic Reproduction License) contract?
The LR is a presentation of the legal terms involved in the publication of an image or images. The LR includes all the previously agreed-to items regarding publication of an image or images, and must be signed by a legally authorized party. Without this signature, a business or individual who uses an image will be liable for all fines and penalties provided by law.

2.0) How to save an image for layout?
To download an image for layout purposes, place the mouse cursor over an image, right click on the image, and select "save image as" in the resulting menu.

How to purchase
3.1) Can I purchase images online?
Yes. The following necessary steps are necessary to purchase images online:
1. register so that we know who you are and how/where to send your purchase requests.
2. use “quick seach” or “advanced search” to find images. For more information on search, “click here”.
3. use your lightbox (
) to pre-select and store your favorite images.
4. enter as much information as you can provide on the online order form and then click the "OK" button at the bottom of the form. This form sends us an e-mail informing us of your order request. A copy of this message is also sent to the e-mail address you provided during registration. We will respond to your order within 12 hours, during normal business hours.
5. after all necessary interested parties sign the written agreement, we will send the image(s) to you in high-resolution by e-mail.

3.2) Can I "save" an image from TYBA Online to my hard drive? How do I do this?
Yes. All of the images on TYBA Online are available in low resolution (largest width of 500 pixels). When using quick search or advanced search, below each miniature image displayed on the search results page is a zoom icon (
) Click on this icon to expand the image size.
Place the mouse cursor over an image, right click on the image, and select "save image as" in the resulting menu.
Upon selecting "save image as" the "save file to" window will open, giving you the opportunity to choose where you would like to save the image on your computer.

The Lightbox
4.1 ) What is a lightbox?
Each registered user of TYBA Online is provided with a lightbox, which helps organize the search process. With it, you can select and store your favorite images for up to three months, or for later purchase.
The lightbox is available in two incarnations:
A - once logged in, your lightbox bar is located below every page accessed on TYBA Online, with the exception of the full-page version of the lightbox. It is a small version of your lightbox, which displays miniatures of all your selected images, allowing you to navigate throughout TYBA Online while simultaneously being able to see all your favorite images.
B - the full-page lightbox allows you to better view all of your selected images. It can be accessed easily by clicking on the "my account" link, followed by the "lightbox" link displayed in the navigation bar. You can also click on the "view my lightbox in full screen format" in your lighbox bar.
To use this service, you must register.

4.2) How do I add or remove an image in my lightbox?
Conducting a search request using "quick search" or "advanced search" results in the display of the search results page. Below all of the miniature images displayed on the search results page there is a lightbox icon (
) which when clicked upon automatically places that image in your lightbox.
At this moment, the person lightbox provides three options: remove, select all images, and quote request. Beside each image in the lightbox bar and on the full lightbox page there is a checkbox. Click on the checkboxes to select images individually, or click on the select all button to automatically select all the images in your lightbox, and then click on either the remove or quote request buttons.
To use this service, you must be registered and logged-in to TYBA Online.

The TYBA watermark
5.1) What is a watermark?
A watermark is a graphic element imposed upon a digital image that identifies its origin and at the same time protects the image from unauthorized use. On TYBA Online, the TYBA symbol (
) is imposed transparently upon every digital image in conjunction with the phrase "Copyright © TYBA".

You must register, select your desired images using your personal lightbox, and request a quote. Images will only be released without a watermark to registered users. If you have any further doubts about the process, contact us.

Registration
6.1) Why should I register?
Once you register, you have access to your lightbox, plus you have the ability to receive images without a watermark. Registration is necessary to use these services.

6.2) How do I register?
All you need to do is click on the register link on TYBA Online´s homepage. Registration is free, and once registered, a cookie will be installed on your computer, allowing you to automatically log in each time you visit TYBA Online. To log out, simply click on the logout link on any page where it is located. But remember, you only have access to your lightbox when you are logged in.

6.3) I forgot my password. What should I do?
If you have intentionally or accidentally logged out and have forgotten your password to log back in, on the login page beside the password box there is a forgot my password link. Click on the link, enter your email address in the field on the resulting pop-up box, and click "OK". If you are a registered user, your password will be sent to your registered email address within a few minutes.
